Terms and Conditions:

 No money is required to claim this offer.  A 50% deposit will be due at the time of drafting of the Will Package, with balance due upon execution of the documents.  Execution of the documents must occur no later than February 28th, 2018.  Taxes are extra.  Offer must be redeemed by January 26th, 2018.   Available to Alberta residents only.  Valid on new wills only.  Limit of one per person. WILL

A Will takes effect upon the death of the person making the Will (the Testator) and provides instruction to an appointed person (the Executor) for distribution of the Testator’s assets after death.  Assets can be left to family members, friends, charities or any other entity, in general.

 

If there is no Will, the distribution of the estate of the deceased is governed by the Wills and Succession Act.  This Act directs distribution amongst the immediate family of the deceased, including a spouse, without discretion or allowances for non-family members.

 

ENDURING POWER OF ATTORNEY

An Enduring Power of Attorney (EPA) operates while the maker is still alive, but is not capable of making their own decisions related to their finances.  

 

The EPA gives authority to another person to make financial decisions for the maker over all aspects of the makers finances.  This authority includes the ability to pay bills, do regular banking, make tax elections and to deal with real property.

 

It is usually brought into effect on some contingency taking place, most typically the mental incapacity of the maker.  It can also be activated on some other event, such as a physical incapacity or on declaration.

 

The EPA remains in effect throughout any period of mental incapacity and provides complete financial authority over the maker’s affairs.  The EPA terminates on the death of the maker, when the remaining estate is managed under provisions of the Will. 

 

PERSONAL DIRECTIVE

A Personal Directive (PD) operates while the maker is still alive, but is not capable of making their own decisions related to their personal affairs, and which are not related to their finances.

 

A PD is similar to an EPA in that it gives authority to another person while the maker is alive but cannot make their own decisions relating to their personal care, health care, or living accommodations.  Authority is given to decide on the maker’s living arrangements, daily care arrangements and medical care, including decisions regarding the termination of life support.

 

The Personal Directive is brought into effect upon the mental incapacity of the maker, and terminates upon the death of the maker.
